Photo / Model Release

This Photo / Model Release (this "Release") is entered into as of the date of the last signature below, by and between:

model_name (the "Model"); and

photographer_name (the "Photographer" or "Creator").

1. Shoot Information

This Release pertains to the photographic session, video production, or other content creation session (the "Shoot") conducted on or about shoot_date, at a location determined by the Photographer.

The Model acknowledges that during the Shoot, the Photographer captured photographs, video footage, audio recordings, and/or other visual or audiovisual content featuring the Model's image, likeness, voice, and/or appearance (collectively, the "Content").

2. Grant of Rights

2.1 Broad Grant

In consideration of the compensation described below, the Model hereby grants to the Photographer, and the Photographer's assigns, licensees, successors, and legal representatives, an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, publish, display, distribute, modify, create derivative works from, and otherwise exploit the Content in all media now known or hereafter devised, including but not limited to:

(a) Print media, including magazines, newspapers, books, brochures, catalogs, and promotional materials;

(b) Digital media, including websites, social media platforms, email marketing, blogs, and online advertising;

(c) Broadcast media, including television, film, video, and streaming platforms;

(d) Advertising and commercial purposes, including product packaging, billboards, point-of-sale displays, and branded content;

(e) Fine art purposes, including gallery exhibitions, art prints, and art publications;

(f) Stock photography and video licensing through any stock agency or marketplace;

(g) Editorial purposes, including news, documentary, and educational content.

2.2 Modifications

The Model grants the Photographer the right to edit, crop, retouch, alter, composite, distort, or otherwise modify the Content without restriction and without the Model's prior approval. The Model waives any right to inspect or approve the finished Content or the use to which it may be applied.

2.3 Name and Likeness

The Photographer may use the Model's name, biographical information, and likeness in connection with the Content, or may use the Content without identifying the Model, at the Photographer's sole discretion.

3. Compensation

In consideration for the rights granted herein, the Model shall receive the following compensation: compensation. The Model acknowledges that this compensation is adequate and sufficient, and that no further compensation is owed or expected.

If no monetary compensation is specified above, the Model acknowledges that the opportunity to participate in the Shoot and/or to receive copies of the Content constitutes adequate consideration for this Release.

The Model is solely responsible for any taxes owed on compensation received under this Release.

4. No Further Claims

The Model hereby releases, discharges, and agrees to hold harmless the Photographer, and the Photographer's agents, employees, licensees, successors, and assigns, from any and all claims, demands, or causes of action that the Model may have or may hereafter have arising from or relating to the use of the Content, including but not limited to claims for:

(a) Invasion of privacy;

(b) Right of publicity;

(c) Defamation or false light;

(d) Intentional or negligent infliction of emotional distress;

(e) Copyright infringement (to the extent the Model may have any rights);

(f) Any other claim arising from the use of the Content as described herein.

The Model acknowledges that the Content may be used in contexts that the Model did not anticipate at the time of the Shoot, and the Model waives any objection to such use.

5. Representations and Warranties

The Model represents and warrants that: (a) the Model is of legal age (18 years or older) and has the legal capacity to enter into this Release; (b) the Model has not previously granted any rights in the Content that would conflict with this Release; (c) the Model has not and will not bring any claim against the Photographer for use of the Content in accordance with this Release; and (d) the Model's consent is voluntary and was not obtained through fraud, duress, or undue influence.

6. Minors Clause

If the Model is under the age of eighteen (18) at the time of the Shoot, the Model's parent or legal guardian must sign this Release on the Model's behalf. The parent or legal guardian represents that they have the legal authority to grant the rights described herein and agrees to be bound by all terms of this Release.

7. Governing Law

This Release shall be governed by and construed in accordance with the laws of the state in which the Shoot takes place. Any dispute arising under this Release shall be resolved in the courts of competent jurisdiction in such state.

8. General Provisions

8.1 Entire Agreement

This Release constitutes the entire agreement between the Parties and supersedes all prior agreements regarding the Content.

8.2 Severability

If any provision is found invalid, the remaining provisions shall continue in full force and effect.

8.3 Binding Effect

This Release shall be binding upon the Model and the Model's heirs, executors, administrators, and assigns. This Release shall inure to the benefit of the Photographer and the Photographer's heirs, successors, licensees, and assigns.
