Room Rental Agreement

Agreement for renting a room within a shared house or apartment, covering house rules and shared space responsibilities.

Room Rental Agreement

This Room Rental Agreement (this "Agreement") is entered into by and between:

homeowner_name (the "Homeowner"); and

tenant_name (the "Tenant").

The Homeowner and Tenant are collectively referred to as the "Parties."


1. Property and Room

1.1 Property

The property is located at property_address (the "Property").

1.2 Room

Homeowner agrees to rent to Tenant the following room within the Property: room_description (the "Room"). The Room is for the exclusive use of Tenant, subject to the terms of this Agreement.

1.3 Furnishings

The Room is provided with the following furnishings (if any): [list furnishings, or state "unfurnished"]. Tenant shall maintain all furnishings in good condition and shall not remove furnishings from the Room without Homeowner's consent.

2. Shared Spaces

In addition to the Room, Tenant shall have shared access to the following common areas of the Property:

(a) Kitchen — shared with all household occupants;

(b) Living room and dining area — shared with all household occupants;

(c) Bathroom(s) — [specify which bathroom(s) are shared and which, if any, are private];

(d) Laundry facilities — shared;

(e) Outdoor areas, patio, or yard — shared; and

(f) [Any other shared spaces — garage, storage, etc.].

Tenant shall use all shared spaces respectfully and shall not monopolize common areas or restrict other household members' reasonable use thereof.

3. Term

3.1 Tenancy Type

This Agreement creates a month-to-month tenancy commencing on the date specified below, unless the Parties agree in writing to a fixed term.

3.2 Termination

Either Party may terminate this Agreement at the end of any monthly period by providing at least thirty (30) days written notice. The termination date shall be the last day of a calendar month.

3.3 Immediate Termination

Homeowner may terminate this Agreement immediately upon written notice if Tenant: (a) engages in illegal activity on the Property; (b) poses a threat to the safety of other occupants; (c) causes substantial damage to the Property; or (d) materially violates the house rules set forth herein after receiving one written warning.

4. Rent

4.1 Amount and Due Date

Tenant shall pay monthly rent of monthly_rent (the "Rent"), due on the first (1st) day of each calendar month.

4.2 What Rent Includes

Rent includes: [specify what is included — e.g., use of the Room, access to shared spaces, and the following utilities: water, trash, Wi-Fi]. The following are NOT included in Rent and shall be Tenant's separate responsibility: [specify — e.g., electricity, gas, phone, personal streaming subscriptions].

4.3 Payment Method

Rent shall be paid by [check, Venmo, Zelle, electronic transfer, or other agreed method] to [payment details].

4.4 Late Fees

If Rent is not received by the fifth (5th) day of the month, Tenant shall pay a late fee of $25.00, or the maximum permitted by applicable law, whichever is less.

4.5 Rent Increases

Homeowner may increase Rent by providing at least thirty (30) days written notice prior to the effective date.

5. Security Deposit

Tenant shall pay a security deposit of [amount] upon execution of this Agreement. The deposit shall be returned within the time required by applicable law after Tenant vacates, less deductions for unpaid Rent or damage beyond normal wear and tear. Homeowner shall provide an itemized list of any deductions.

6. House Rules

Tenant agrees to comply with the following house rules, which may be amended by Homeowner upon thirty (30) days written notice:

6.1 Quiet Hours

Quiet hours shall be observed from 10:00 PM to 7:00 AM on weekdays and 11:00 PM to 8:00 AM on weekends. During quiet hours, Tenant shall keep noise to a minimum, including music, television, phone conversations, and any other activity that may disturb other occupants.

6.2 Guests

Tenant may have guests visit the Property subject to the following conditions:

(a) Overnight guests are permitted for a maximum of three (3) consecutive nights and no more than six (6) nights per month without Homeowner's written consent;

(b) Guests shall not be given keys or access codes to the Property without Homeowner's permission;

(c) Tenant is responsible for the behavior of all guests and for any damage caused by guests;

(d) Guests shall comply with all house rules; and

(e) No guest may effectively become an additional occupant (staying more than the permitted nights).

6.3 Kitchen Use

(a) Tenant shall clean all dishes, utensils, and cooking surfaces immediately after use;

(b) Tenant shall store food in designated areas (Tenant shall have designated shelf/drawer space in the refrigerator and pantry);

(c) Tenant shall not use or consume other household members' food without permission;

(d) Tenant shall not leave food unattended while cooking;

(e) Tenant shall take out the trash when the receptacle is full or on a rotating schedule as agreed upon; and

(f) Tenant shall keep the kitchen clean and free of pests.

6.4 Bathroom Use

(a) Tenant shall clean the bathroom after each use (wipe down surfaces, clean hair from drains);

(b) Shared bathrooms shall be thoroughly cleaned on a rotating schedule agreed upon by all household members;

(c) Tenant shall provide personal toiletries and shall not use others' personal items; and

(d) Showers shall be limited to reasonable durations to ensure adequate hot water for all occupants.

6.5 Cleaning Responsibilities

(a) Tenant shall keep the Room clean and sanitary at all times;

(b) Shared spaces shall be cleaned on a rotating schedule agreed upon by all household members;

(c) Each household member shall clean up after themselves promptly in all shared spaces; and

(d) A deep cleaning of the entire shared area shall be conducted at least once per month on a rotating basis.

6.6 Smoking

Smoking (including e-cigarettes and vaping) is strictly prohibited inside the Property, including in the Room. Smoking is only permitted in designated outdoor areas, if any.

6.7 Alcohol and Substances

The use of illegal substances on the Property is strictly prohibited and shall constitute grounds for immediate termination. Alcohol consumption is permitted in moderation but shall not result in disruptive behavior.

7. Parking

Tenant shall have access to the following parking: [describe — e.g., one driveway spot, street parking only, garage space, etc.]. Tenant shall not block other household members' vehicles or access to the Property.

8. Storage

Tenant may store personal belongings in the Room and in the following designated storage area(s): [describe, if any]. Tenant shall not store items in common areas, hallways, or other non-designated spaces without Homeowner's consent.

9. Pets

No pets shall be kept without Homeowner's prior written consent. If a pet is approved, Tenant shall be responsible for all damage, noise, and odor caused by the pet and shall comply with all applicable laws. Service animals shall be accommodated in accordance with applicable law.

10. Maintenance and Repairs

Homeowner shall be responsible for structural repairs, major appliances, plumbing, electrical, and HVAC systems. Tenant shall promptly report any maintenance issues. Tenant shall be responsible for any damage caused by Tenant or Tenant's guests to the Room or shared spaces, beyond normal wear and tear.

11. Alterations

Tenant shall not make any alterations to the Room or shared spaces without Homeowner's prior written consent. This includes painting, installing shelves, or making holes in walls. Tenant may use temporary, removable hooks and adhesives for hanging decorations.

12. Personal Property and Liability

Homeowner shall not be liable for any loss, theft, or damage to Tenant's personal property. Tenant is encouraged to obtain renter's insurance to protect personal belongings. Tenant shall be liable for any damage Tenant causes to the Property or to other occupants' property.

13. Entry to Room

Homeowner shall provide at least twenty-four (24) hours advance written notice before entering the Room, except in cases of emergency. The Room is Tenant's private space, and Homeowner shall respect Tenant's privacy.

14. Move-Out Procedures

Upon termination of this Agreement, Tenant shall:

(a) Remove all personal belongings from the Room, shared spaces, and storage areas;

(b) Clean the Room thoroughly;

(c) Return all keys, access codes, and garage openers;

(d) Repair any damage beyond normal wear and tear;

(e) Complete any remaining cleaning responsibilities; and

(f) Provide a forwarding address for the return of the Security Deposit.

Any personal property left after the move-out date may be disposed of after seven (7) days written notice.

15. Dispute Resolution

The Parties shall attempt to resolve any disputes through good-faith discussion. If a dispute cannot be resolved informally, the Parties agree to attempt mediation before pursuing legal remedies.

16. Governing Law

This Agreement shall be governed by the laws of the state in which the Property is located.

17. General Provisions

17.1 Entire Agreement

This Agreement constitutes the entire agreement between the Parties regarding the room rental.

17.2 Amendments

This Agreement may only be amended by a written instrument signed by both Parties.

17.3 Severability

If any provision is held invalid, the remaining provisions shall remain in effect.

17.4 Notices

All notices shall be in writing and delivered personally, by text message (with confirmation), or by email.

17.5 Counterparts

This Agreement may be executed in counterparts. Electronic signatures shall be deemed original signatures.
