A comprehensive roommate agreement covering rent, utilities, house rules, guests, cleaning, and dispute resolution.

Roommate Agreement

This Roommate Agreement (this "Agreement") is entered into as of the date of the last signature below, by and between:

roommate_a ("Roommate A"); and

roommate_b ("Roommate B").

Roommate A and Roommate B are each referred to herein as a "Roommate" and collectively as the "Roommates." The Roommates agree to the following terms and conditions governing their shared living arrangement at the property described below.


1. Property

The Roommates shall reside together at property_address (the "Property" or "Premises"). The lease for the Property commences on lease_start_date (the "Lease Start Date"). Each Roommate shall be named on the lease or sublease for the Property, or one Roommate shall serve as the primary leaseholder with the consent of the landlord.

The Roommates acknowledge that they have inspected the Property and agree that it is in acceptable condition as of the Lease Start Date. Any pre-existing damage shall be documented in writing and shared with the landlord.

2. Rent

2.1 Total Rent and Split

The total monthly rent for the Property is monthly_rent. Unless otherwise agreed in writing, the Roommates shall split the rent equally, with each Roommate paying one-half (1/2) of the total monthly rent.

If the Roommates agree to an unequal rent split (for example, due to different bedroom sizes or amenities), the specific amounts shall be documented in a written addendum to this Agreement.

2.2 Payment Due Date

Each Roommate's share of the rent shall be due on the first (1st) day of each calendar month. If the first day falls on a weekend or holiday, payment shall be due on the next business day. Rent shall be paid to the landlord or the designated Roommate responsible for collecting and remitting rent.

2.3 Late Rent

If either Roommate fails to pay their share of the rent by the fifth (5th) day of the month, the delinquent Roommate shall be solely responsible for any late fees charged by the landlord. Repeated late payments (three or more within a twelve-month period) shall constitute a material breach of this Agreement.

3. Utilities

3.1 Utility Responsibilities

The Roommates shall share equally the cost of the following utilities: electricity, gas, water, sewer, trash collection, internet, and any other shared household services. Each Roommate shall pay one-half (1/2) of the total cost of shared utilities each month.

3.2 Utility Payment

One Roommate shall be designated to manage utility accounts and payments. The other Roommate shall reimburse their share within five (5) days of receiving a written or electronic request for payment, accompanied by copies of the relevant utility bills.

If either Roommate wishes to add a premium utility service (such as an upgraded internet plan or cable television), that Roommate shall bear the additional cost unless the other Roommate agrees in writing to share the expense.

3.3 Conservation

Both Roommates agree to make reasonable efforts to conserve utilities, including turning off lights and appliances when not in use, setting the thermostat to mutually agreed-upon temperatures, and reporting any leaks or maintenance issues promptly.

4. Security Deposit

Each Roommate shall contribute equally to the security deposit required by the landlord. Upon move-out, the security deposit refund (less any deductions for damages) shall be split equally between the Roommates, unless specific damages are attributable to one Roommate, in which case the responsible Roommate shall bear those deductions.

If one Roommate moves out before the other, the departing Roommate's share of the security deposit shall be refunded by the remaining Roommate or a replacement roommate, or the departing Roommate shall wait until the lease ends and the security deposit is returned by the landlord.

5. House Rules

5.1 Common Areas

Both Roommates shall have equal access to all common areas of the Property, including the kitchen, living room, bathroom(s), and any outdoor spaces. Neither Roommate shall claim exclusive use of any common area without the other's written consent.

Personal belongings shall be kept in each Roommate's private space (bedroom) and not left in common areas for extended periods. Each Roommate shall maintain common areas in a clean and orderly condition.

5.2 Quiet Hours

Quiet hours shall be observed from 10:00 PM to 8:00 AM Sunday through Thursday, and from 12:00 AM (midnight) to 9:00 AM on Friday and Saturday nights. During quiet hours, Roommates shall refrain from loud music, television at high volume, phone calls on speaker, or any other noise that would disturb the other Roommate's sleep.

Exceptions to quiet hours may be made by mutual written or verbal agreement for special occasions, provided at least 48 hours' notice is given.

5.3 Smoking

Smoking of any kind (including cigarettes, cigars, vaping, and cannabis where legal) is prohibited inside the Property. Smoking shall be conducted only in designated outdoor areas, if any, and in compliance with the landlord's rules and applicable law.

6. Guests

6.1 Overnight Guests

Each Roommate may have overnight guests for up to three (3) consecutive nights without prior approval from the other Roommate. Overnight stays exceeding three consecutive nights require advance written notice to and approval from the other Roommate.

No guest shall stay more than ten (10) nights in any calendar month. If a guest stays more frequently, the hosting Roommate shall be responsible for an additional share of utilities proportional to the guest's occupancy.

6.2 Guest Conduct

Each Roommate is responsible for the behavior of their guests. Guests must comply with all house rules, including quiet hours. Any damage caused by a guest shall be the sole responsibility of the hosting Roommate.

Guests shall not be given keys or access codes to the Property without the other Roommate's consent. Under no circumstances shall a guest move into the Property without a written amendment to this Agreement.

7. Cleaning

7.1 Cleaning Responsibilities

Both Roommates shall maintain the Property in a clean and sanitary condition. A cleaning schedule shall be established by mutual agreement and may be rotated weekly. The cleaning schedule shall cover: vacuuming/sweeping, mopping, bathroom cleaning, kitchen cleaning (including dishes, counters, and appliances), and trash removal.

7.2 Personal Cleanliness

Each Roommate shall clean up after themselves promptly. Dishes shall be washed or placed in the dishwasher within 24 hours of use. Spills shall be cleaned immediately. Personal items shall not be left in common areas.

If one Roommate consistently fails to fulfill their cleaning responsibilities, the other Roommate may, after providing written notice, hire a cleaning service and charge the delinquent Roommate for their share of the cost.

8. Food and Kitchen

8.1 Food Sharing

Unless otherwise agreed, each Roommate shall purchase their own food and beverages. Shared food items (such as cooking oil, spices, and condiments) may be purchased jointly, with costs split equally.

Neither Roommate shall consume the other Roommate's food or beverages without express permission. Shared refrigerator space shall be divided equally, and each Roommate shall label their items if desired.

8.2 Kitchen Use

Both Roommates shall have equal access to the kitchen and all shared appliances. After cooking, the kitchen shall be cleaned promptly, including wiping down counters, cleaning the stovetop, and washing all dishes and utensils used.

9. Pets

No pets shall be brought into the Property without the prior written consent of both Roommates and the landlord. If a pet is approved, the Roommate who owns the pet shall be solely responsible for all costs associated with the pet, including food, veterinary care, grooming, and any damage or additional deposits required by the landlord.

The pet-owning Roommate shall keep the pet under control at all times, clean up after the pet promptly, and ensure the pet does not create excessive noise or disturbance. If the pet causes ongoing issues that cannot be resolved, the pet-owning Roommate shall make alternative arrangements for the pet within thirty (30) days of written notice from the other Roommate.

10. Parking

If the Property includes parking spaces, the Roommates shall divide parking spaces equally. If only one space is available, the Roommates shall alternate use or agree on a fair arrangement. Any assigned parking shall be documented in writing.

Neither Roommate shall park in the other Roommate's designated space without permission. Visitors' vehicles must be parked in visitor-designated areas or on the street, not in the other Roommate's space.

11. Personal Property

Each Roommate's personal property remains their own. Neither Roommate shall use, borrow, move, or dispose of the other Roommate's personal property without express permission. Any shared furniture or household items purchased jointly shall be documented, and ownership or disposition upon move-out shall be addressed in writing.

Each Roommate is responsible for obtaining renter's insurance to cover their own personal property. Neither Roommate shall be liable for loss or damage to the other's personal property unless caused by the negligent or intentional acts of the responsible Roommate.

12. Move-Out Procedures

12.1 Notice of Intent to Move Out

Either Roommate may terminate this Agreement by providing at least thirty (30) days' written notice to the other Roommate. The departing Roommate shall also comply with any notice requirements in the underlying lease.

12.2 Replacement Roommate

If one Roommate moves out before the lease expires, the departing Roommate shall make reasonable efforts to find a suitable replacement roommate, subject to the remaining Roommate's approval and the landlord's consent. The departing Roommate shall remain responsible for their share of the rent until a replacement roommate moves in or the lease expires, whichever comes first.

12.3 Move-Out Condition

Upon move-out, the departing Roommate shall remove all personal belongings, clean their bedroom and any private spaces, and leave all common areas in good condition. Any damage beyond normal wear and tear caused by the departing Roommate shall be repaired at the departing Roommate's expense.

13. Dispute Resolution

13.1 Good Faith Discussion

The Roommates agree to attempt to resolve any dispute arising under this Agreement through good faith discussion and negotiation before pursuing any formal dispute resolution mechanism.

13.2 Mediation

If the Roommates are unable to resolve a dispute through discussion within fourteen (14) days, either Roommate may request mediation. The Roommates shall select a mutually agreeable mediator and share the cost of mediation equally.

13.3 Binding Arbitration

If mediation fails to resolve the dispute within thirty (30) days of the mediator's appointment, either Roommate may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. The costs of arbitration shall be shared equally unless the arbitrator directs otherwise.

14. General Provisions

14.1 Entire Agreement

This Agreement constitutes the entire agreement between the Roommates regarding their shared living arrangement and supersedes all prior agreements, discussions, and understandings.

14.2 Amendments

This Agreement may be amended only by a written instrument signed by both Roommates.

14.3 Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.4 Governing Law

This Agreement shall be governed by the laws of the state in which the Property is located.
