Babysitter/Nanny Employment Agreement
This Babysitter/Nanny Employment Agreement (this "Agreement") is entered into as of start_date (the "Start Date"), by and between:
The family_name Family (the "Family" or "Employer"); and
nanny_name (the "Nanny" or "Caregiver").
The Family and the Nanny are each referred to herein as a "Party" and collectively as the "Parties." This Agreement sets forth the terms and conditions of the Nanny's employment with the Family.
1. Children
The Nanny shall provide care for the following child(ren): child_names (the "Child" or "Children"). The Nanny acknowledges that the safety, well-being, and developmental needs of the Children are the primary responsibilities under this Agreement.
If additional children join the Family (by birth, adoption, or other means), the Parties shall negotiate in good faith to amend this Agreement to reflect the additional responsibilities and any corresponding adjustments to compensation.
2. Work Schedule
2.1 Regular Schedule
The Nanny's regular work schedule shall be Monday through Friday, from 8:00 AM to 6:00 PM, unless otherwise agreed in writing. The total regular work week shall not exceed fifty (50) hours. The specific schedule may be adjusted by mutual written agreement.
The Family shall provide the Nanny with at least two (2) weeks' notice of any permanent changes to the regular schedule. Temporary schedule changes shall be communicated at least 48 hours in advance when possible.
2.2 Flexibility
The Nanny agrees to be reasonably flexible with scheduling to accommodate the Family's occasional needs, including early arrivals, late pickups, and schedule changes. The Family agrees to minimize last-minute schedule changes and to compensate the Nanny for any additional hours worked.
2.3 Overnight and Weekend Care
If the Family requires overnight or weekend care, the Parties shall agree in advance on compensation for such hours. Overnight care shall be compensated at the regular hourly rate for all hours during which the Nanny is required to be awake and actively caring for the Children, and at a reduced flat rate for sleeping hours if the Nanny is permitted to sleep.
3. Duties and Responsibilities
3.1 Childcare Duties
The Nanny's primary duties shall include: supervising and ensuring the safety of the Children at all times; preparing meals and snacks for the Children; assisting with homework and educational activities; transporting the Children to school, activities, and appointments; bathing and dressing the Children as appropriate for their age; administering prescribed medications as directed by the Family; maintaining the Children's daily routine including nap times and bedtimes; and engaging the Children in age-appropriate activities, play, and learning.
3.2 Light Household Duties
The Nanny shall perform the following light household duties related to the Children's care: doing the Children's laundry; tidying the Children's rooms and play areas; washing the Children's dishes and bottles; organizing the Children's belongings, clothing, and toys; and keeping the kitchen clean after preparing the Children's meals.
The Nanny is not responsible for general housekeeping, including cleaning areas not used by the Children, doing the Family's laundry, or performing yard work, unless separately agreed upon and compensated.
3.3 Activities and Development
The Nanny shall plan and facilitate age-appropriate activities that support the Children's physical, emotional, social, and cognitive development. These activities may include reading, arts and crafts, outdoor play, educational games, music, and social interactions with other children.
The Nanny shall communicate with the Family about the Children's developmental progress, behavioral observations, and any concerns. The Nanny shall follow the Family's parenting philosophy and disciplinary guidelines as communicated in writing.
4. Compensation
4.1 Hourly Rate
The Family shall pay the Nanny at the rate of hourly_rate per hour for all hours worked (the "Hourly Rate"). The Nanny shall be paid on a bi-weekly basis, with payments issued on every other Friday or the next business day if Friday falls on a holiday.
4.2 Overtime
Hours worked in excess of forty (40) hours per week shall be compensated at one and one-half (1.5) times the regular Hourly Rate, in accordance with applicable federal and state labor laws. The Family acknowledges its obligation to comply with all applicable wage and hour laws.
4.3 Guaranteed Hours
The Nanny shall be guaranteed a minimum of forty (40) hours of pay per week, regardless of whether the Family requires the Nanny's services for the full forty hours. If the Family cancels a scheduled workday, the Nanny shall still be paid for the scheduled hours.
The guaranteed hours provision shall not apply during the Nanny's paid time off, holidays, or any period during which the Nanny is unable to work due to the Nanny's own illness or personal reasons.
4.4 Taxes and Withholding
The Family acknowledges that the Nanny is a household employee for tax purposes and agrees to comply with all applicable federal, state, and local tax requirements, including withholding and remitting Social Security, Medicare, federal income tax, state income tax, and unemployment insurance as required by law.
The Family shall provide the Nanny with a W-2 form by January 31 of each year for the preceding tax year. The Nanny shall complete a W-4 form and any applicable state tax withholding forms prior to the Start Date.
4.5 Expense Reimbursement
The Family shall reimburse the Nanny for all reasonable, pre-approved expenses incurred in connection with the care of the Children, including mileage for transporting the Children (at the current IRS standard mileage rate), admission fees for activities, and supplies purchased for the Children. The Nanny shall submit receipts for reimbursement within fourteen (14) days of incurring the expense.
5. Paid Time Off
5.1 Vacation Days
The Nanny shall receive ten (10) paid vacation days per year, accruing at the rate of approximately 0.83 days per month. Vacation days may be used after the first ninety (90) days of employment. The Nanny shall provide at least two (2) weeks' notice for vacation requests of three (3) or more consecutive days.
Unused vacation days shall not carry over from year to year unless agreed in writing. Upon termination of employment, the Nanny shall be paid for any accrued but unused vacation days.
5.2 Sick Days
The Nanny shall receive five (5) paid sick days per year. Sick days are to be used when the Nanny is ill or needs to attend medical appointments. The Nanny shall notify the Family as early as possible (preferably before 7:00 AM) on any day the Nanny will be absent due to illness.
If the Nanny requires more than three (3) consecutive sick days, the Family may request a doctor's note confirming the Nanny's illness and estimated return date.
5.3 Holidays
The Nanny shall receive the following paid holidays: New Year's Day, Martin Luther King Jr. Day, Presidents' Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving, Christmas Eve, Christmas Day, and New Year's Eve. If the Nanny is required to work on a holiday, the Nanny shall be compensated at one and one-half (1.5) times the regular Hourly Rate.
6. House Rules and Guidelines
6.1 Screen Time
The Nanny shall adhere to the Family's screen time guidelines for the Children. Unless otherwise directed by the Family, screen time (including television, tablets, phones, and computers) shall be limited to one (1) hour per day for Children over age two, and no screen time for Children under age two, consistent with pediatric recommendations.
6.2 Diet and Nutrition
The Nanny shall follow the Family's dietary guidelines for the Children, including any food allergies, restrictions, or preferences communicated in writing. The Nanny shall prepare balanced, nutritious meals and snacks. No food shall be given to the Children that is on the Family's prohibited list.
6.3 Discipline
The Nanny shall use only positive discipline techniques, including redirection, positive reinforcement, natural consequences, and age-appropriate reasoning. Corporal punishment, yelling, shaming, and any form of physical or emotional punishment are strictly prohibited.
The Nanny shall communicate behavioral issues to the Family promptly and work collaboratively with the Family to address any behavioral concerns consistently.
6.4 Visitors
The Nanny shall not invite personal visitors to the Family's home during working hours without the Family's prior written approval. Other nannies and children may visit for playdates with the Family's advance approval.
6.5 Transportation and Driving
If the Nanny is required to drive the Children, the Nanny shall maintain a valid driver's license, a clean driving record, and adequate automobile insurance. The Family shall provide appropriate car seats for each Child. The Nanny shall comply with all traffic laws and shall not use a mobile phone while driving with the Children.
7. Emergency Procedures
The Family shall provide the Nanny with a written emergency information sheet, including: emergency contact numbers for both parents/guardians; the Children's pediatrician name and phone number; the nearest hospital and urgent care facility; known allergies and medical conditions for each Child; insurance information; and a signed medical consent form authorizing the Nanny to seek emergency medical treatment for the Children.
In the event of a medical emergency, the Nanny shall call 911 first, then notify the Family immediately. The Nanny shall accompany the Children to the hospital or emergency facility and remain with them until a parent/guardian arrives.
The Nanny shall be trained in infant/child CPR and basic first aid. The Family shall reimburse the Nanny for the cost of CPR/first aid certification and any required renewals.
8. Confidentiality
The Nanny shall maintain the confidentiality of all personal, financial, and family information learned during the course of employment. This includes but is not limited to: the Family's home address, alarm codes, and security information; financial information, work schedules, and personal matters; the Children's medical information, school information, and behavioral matters; and the Family's relationships, routines, and personal affairs.
The Nanny shall not share photographs or videos of the Children on social media or with any third party without the Family's express written consent. This confidentiality obligation shall survive the termination of this Agreement.
9. Termination
9.1 Termination With Notice
Either Party may terminate this Agreement at any time by providing at least two (2) weeks' written notice to the other Party. During the notice period, the Nanny shall continue to perform all duties in a professional manner, and the Family shall continue to compensate the Nanny at the regular rate.
9.2 Termination Without Notice
The Family may terminate this Agreement immediately, without notice, for cause, including but not limited to: abuse, neglect, or endangerment of the Children; theft, dishonesty, or fraud; use of drugs or alcohol during working hours; failure to follow emergency procedures; repeated failure to perform duties satisfactorily after written warning; or any criminal conduct.
9.3 Severance
If the Family terminates this Agreement without cause and without providing two (2) weeks' notice, the Family shall pay the Nanny two (2) weeks' pay at the guaranteed hours rate as severance. Severance shall not be owed if termination is for cause.
9.4 Return of Property
Upon termination, the Nanny shall return all Family property, including keys, access cards, security codes, car seats, strollers, and any other items belonging to the Family or the Children. The Family shall return any personal property of the Nanny.
10. General Provisions
10.1 Entire Agreement
This Agreement constitutes the entire agreement between the Parties regarding the Nanny's employment and supersedes all prior agreements and understandings.
10.2 Amendments
This Agreement may be amended only by a written instrument signed by both Parties.
10.3 Severability
If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.4 Governing Law
This Agreement shall be governed by the laws of the state in which the Family resides.
10.5 At-Will Employment
The Nanny's employment is at-will, meaning that either Party may terminate the employment relationship at any time, for any reason or no reason, subject to the notice and severance provisions of this Agreement.
IN WITNESS WHEREOF, the Parties have executed this Babysitter/Nanny Employment Agreement as of the Start Date.
