Part-Time Employment Agreement
This Part-Time Employment Agreement (this "Agreement") is entered into as of start_date (the "Effective Date") by and between:
company_name (the "Company"); and
employee_name (the "Employee").
The Company and Employee are each referred to herein as a "Party" and collectively as the "Parties."
1. Employment and Position
1.1 Position
The Company hereby employs the Employee in the part-time position of position, effective as of start_date. The Employee shall perform such duties and responsibilities as are customarily associated with the position of position and as may be reasonably assigned by the Company from time to time.
1.2 Part-Time Classification
The Employee's position is classified as part-time and non-exempt under the Fair Labor Standards Act ("FLSA") and applicable state law. The Employee acknowledges that part-time status may affect eligibility for certain Company benefits and programs as described herein.
1.3 Reporting
The Employee shall report to the supervisor or manager designated by the Company. The Company reserves the right to modify the Employee's reporting structure at any time with reasonable notice.
1.4 Place of Work
The Employee's primary place of work shall be the Company's offices or such other location as designated by the Company. The Company may require the Employee to travel from time to time as reasonably necessary.
1.5 Best Efforts
During scheduled work hours, the Employee shall devote full attention and best efforts to the performance of assigned duties. The Employee shall perform all duties faithfully, diligently, and in accordance with the Company's policies and procedures.
1.6 Outside Employment
The Employee may engage in outside employment or consulting activities, provided that such activities do not conflict with or interfere with the Employee's duties under this Agreement, do not involve a competitor of the Company, and do not compromise the Employee's ability to protect the Company's Confidential Information. The Employee shall notify the Company of any outside employment.
2. Work Schedule and Hours
2.1 Weekly Hours
The Employee's regular work schedule shall not exceed weekly_hours hours per week. The specific days and hours of work shall be determined by the Company in consultation with the Employee and may be adjusted based on business needs.
2.2 Schedule Flexibility
The Company shall make reasonable efforts to establish a consistent work schedule for the Employee. However, the Company reserves the right to adjust the Employee's schedule, including the days and hours of work, with reasonable advance notice. The Employee shall accommodate schedule changes to the extent reasonably possible.
2.3 Maximum Hours
The Employee's weekly hours shall not exceed weekly_hours hours per week on a regular basis. In no event shall the Employee's weekly hours exceed twenty-nine (29) hours per week on a sustained basis without the prior written approval of the Company. If the Employee's hours consistently exceed this threshold, the Company may reevaluate the Employee's classification and benefits eligibility.
2.4 Overtime
If the Employee is classified as non-exempt, any hours worked in excess of forty (40) hours in a single workweek shall be compensated at one and one-half (1.5) times the Employee's regular hourly rate, in accordance with the FLSA and applicable state law. The Employee shall not work overtime without the prior written approval of the Employee's supervisor.
2.5 Timekeeping
The Employee shall accurately record all hours worked using the Company's designated timekeeping system. The Employee shall record the start and end time of each work period, including any meal or rest breaks. Falsification of time records is grounds for immediate termination.
2.6 Meal and Rest Breaks
The Employee shall be entitled to meal and rest breaks in accordance with applicable state and local law. The Company shall post or otherwise make available information regarding applicable break requirements.
3. Compensation
3.1 Hourly Rate
The Company shall pay the Employee at the hourly rate of hourly_rate per hour (the "Hourly Rate") for all hours worked. The Hourly Rate shall be subject to applicable tax withholdings and authorized deductions. Payment shall be made in accordance with the Company's regular payroll schedule.
3.2 Rate Review
The Company shall review the Employee's Hourly Rate on an annual basis. Any adjustment to the Hourly Rate shall be at the sole discretion of the Company and shall be based on factors including performance, market conditions, and the Company's financial situation.
3.3 Overtime Compensation
If the Employee is classified as non-exempt under the FLSA and applicable state law, overtime hours shall be compensated at one and one-half (1.5) times the regular Hourly Rate. Overtime shall be calculated in accordance with applicable federal and state law. In states with daily overtime requirements, the Employee shall be compensated accordingly.
3.4 Payment Method
Compensation shall be paid by direct deposit to a bank account designated by the Employee, or by check if direct deposit is not available. The Employee shall receive a pay stub or earnings statement with each payment detailing hours worked, gross pay, deductions, and net pay.
3.5 Payroll Deductions
The Company shall deduct from the Employee's compensation all applicable federal, state, and local income taxes, Social Security contributions, Medicare taxes, and any other deductions required by law or authorized by the Employee in writing.
4. Benefits
4.1 Limited Benefits Eligibility
As a part-time employee, the Employee's eligibility for Company benefits may be limited. The Employee shall be eligible for benefits only as required by applicable law and as specifically described in this Section.
4.2 Statutory Benefits
The Employee shall be entitled to all benefits required by applicable federal, state, and local law, including but not limited to: workers' compensation insurance, unemployment insurance, and any paid sick leave or family leave mandated by state or local law.
4.3 Health Insurance
Part-time employees working fewer than thirty (30) hours per week on average are generally not eligible for the Company's group health insurance plan under the Affordable Care Act. If the Employee's hours average thirty (30) or more hours per week over a measurement period, the Employee may become eligible for health insurance coverage as required by law.
4.4 Retirement Plan
The Employee may be eligible to participate in the Company's 401(k) or other retirement plan if the Employee meets the eligibility requirements set forth in the plan documents, which may include minimum age and hours-of-service thresholds.
4.5 Paid Time Off
Part-time employees shall accrue paid time off on a pro-rata basis in proportion to hours worked, as described in the Company's PTO policy. The Employee shall request PTO in advance and obtain approval from the Employee's supervisor.
4.6 Holiday Pay
Part-time employees are not eligible for paid holidays unless specifically provided in the Company's policy. If the Employee is scheduled to work on a Company-designated holiday, the Employee shall be compensated at the regular Hourly Rate unless otherwise required by law.
4.7 Other Benefits
The Company may, in its discretion, extend additional benefits to part-time employees, such as employee discounts, professional development opportunities, or access to employee assistance programs. Eligibility for such benefits shall be governed by the applicable plan documents and Company policies.
5. Conversion to Full-Time
5.1 Conversion Eligibility
The Employee may be considered for conversion to full-time status based on business needs, the Employee's performance, and the availability of full-time positions. Conversion to full-time status is not guaranteed and shall be at the sole discretion of the Company.
5.2 Conversion Process
If the Company determines that a full-time position is available and that the Employee is a suitable candidate, the Company shall notify the Employee in writing of the opportunity to convert to full-time status. The conversion shall be subject to the terms and conditions of a new full-time employment agreement, which the Employee shall be required to sign.
5.3 Benefits Upon Conversion
Upon conversion to full-time status, the Employee shall become eligible for the full range of Company benefits available to full-time employees, subject to any applicable waiting periods set forth in the plan documents. The Employee's tenure with the Company as a part-time employee shall be credited toward any service requirements for benefit eligibility.
5.4 Compensation Upon Conversion
Upon conversion to full-time status, the Employee's compensation shall be adjusted to reflect the full-time position, which may include a transition from an hourly rate to an annual salary. The specific terms of compensation shall be set forth in the new full-time employment agreement.
6. At-Will Employment
The Employee's employment with the Company is "at-will," meaning that either the Company or the Employee may terminate the employment relationship at any time, with or without cause, and with or without notice, subject to applicable law. Nothing in this Agreement creates a contract of employment for any specific term or duration.
No oral or written statements or representations by any representative of the Company shall modify the at-will nature of the Employee's employment unless set forth in a written agreement signed by an authorized officer of the Company.
7. Confidentiality
7.1 Confidential Information
The Employee acknowledges that in the course of employment, the Employee may have access to Confidential Information of the Company, including but not limited to business plans, financial data, customer lists, trade secrets, technical information, and other proprietary information. The Employee agrees to hold all Confidential Information in strict confidence and not to disclose or use such information except in the performance of the Employee's duties.
7.2 Survival
The Employee's obligation to protect Confidential Information shall survive the termination of employment and shall continue for as long as the information remains confidential.
7.3 Return of Materials
Upon termination of employment, the Employee shall return all Company property, documents, files, equipment, and materials containing Confidential Information and shall not retain any copies.
8. Intellectual Property
All inventions, works of authorship, designs, ideas, and other intellectual property created by the Employee during the course of employment and within the scope of the Employee's duties shall be the sole and exclusive property of the Company. The Employee hereby assigns to the Company all rights in and to such intellectual property.
The Employee shall promptly disclose to the Company any inventions or works created during the term of employment that relate to the Company's business and shall cooperate with the Company in securing patent, copyright, or other intellectual property protection at the Company's expense.
9. Termination
9.1 Termination by the Company
The Company may terminate the Employee's employment at any time, with or without cause, by providing notice as required by applicable law. The Company may terminate employment immediately for cause, including but not limited to misconduct, insubordination, violation of Company policies, dishonesty, or poor performance.
9.2 Termination by the Employee
The Employee may resign from employment at any time by providing the Company with at least seven (7) days' written notice. The Company may waive the notice period and accelerate the termination date.
9.3 Final Compensation
Upon termination, the Company shall pay the Employee all earned but unpaid wages and any accrued but unused paid time off, in accordance with applicable law. The final paycheck shall be provided within the time period required by applicable state law.
9.4 Return of Property
Upon termination, the Employee shall return all Company property, including equipment, keys, access cards, documents, electronic files, and any other materials belonging to the Company. The Employee shall cooperate with the Company in transitioning work responsibilities.
10. General Provisions
10.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state in which the Employee primarily works, without regard to its conflict of law principles.
10.2 Entire Agreement
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, representations, and understandings.
10.3 Amendments
This Agreement may not be amended except by a written instrument signed by both Parties.
10.4 Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.5 Waiver
No failure or delay by either Party in exercising any right under this Agreement shall operate as a waiver thereof.
10.6 Notices
All notices under this Agreement shall be in writing and delivered personally, by confirmed email, or by overnight courier to the addresses on file.
10.7 Counterparts
This Agreement may be executed in counterparts, each of which shall be deemed an original. Electronic signatures shall be deemed original signatures for all purposes.
11. Acknowledgment
The Employee acknowledges that the Employee has read this Agreement in its entirety, understands all of its terms, has had the opportunity to consult with an attorney, and is entering into this Agreement voluntarily.
The Company acknowledges that the individual signing on behalf of the Company is duly authorized to bind the Company to the terms of this Agreement.
